    Introduction

    The Gram Panchayat Department is working for the development of the rural areas. The main objective of this department is to implement various activities to create clean, beautiful and green villages, strengthen the Panchayati Raj system through empowerment of people’s representatives under development programs through training, so that the villages in the district should become self-sufficient, all basic facilities should be available there and all facilities should be available to the people there in the villages themselves.

    Through this department, various welfare schemes and activities are implemented for the development of rural areas and citizens. The goal of this department is to achieve constructive, inclusive and sustainable rural development through a strong Panchayat Raj system.

    Special Grants to Gram Panchayats under Urban Facilities Scheme

     

    Scheme details

    Government of Maharashtra and Rural Development Department and Water Conservation Department Government Decision No. VPM-2610/P.No.129 / Para 4 dated 26 September 2010 Special Subsidy for Urban Facilities to Big Gram Panchayats under this scheme the following additional facilities are required.

    PESA Act-

    “Panchayat Provisions (Extension to Scheduled Areas) Act, 1996 i.e. PESA Act has been notified by the Central Government on 24th December, 1996 for Panchayats in Scheduled Areas. Three talukas in Thane district fall in the Scheduled Area, Shahapur taluka is fully Scheduled and Murbad and Bhiwandi fall in the Partially Scheduled Area.

    Scheme

    Regarding direct provision of 5% unallocated funds to Gram Panchayats in Scheduled Areas of the State

    • The Central Government has notified the “Panchayat Provisions (Extension to Scheduled Areas) Act, 1996” i.e. PESA Act on 24th December, 1996 for the Panchayats in Scheduled Areas. In order to strengthen the Panchayats in Scheduled Areas as institutions of self-government, it is the responsibility of the State to give powers and authority consistent with the PESA Act to the Panchayats at the appropriate level. In that regard, it is necessary to implement various schemes to make the Gram Panchayats in Scheduled Areas self-sufficient and financially empowered. As part of this, the Hon’ble Governor, in exercise of the powers vested in him under sub-paragraph (1) of paragraph 5 of Schedule 5 of the Constitution of India, has amended section 54(b) of the Maharashtra Gram Panchayats Act (Bombay Act No. 3 of 1959) and inserted a new clause (o) as follows: “(o) shall be empowered to control the resources of local schemes including tribal schemes and the resources of such schemes: Provided that, in each year, a sum not less than 5 per cent of the total Tribal Component Programme Fund as shown in the Annual Financial Statement, shall be allocated to the Maharashtra Scheduled Areas The Gram Panchayats shall be given funds in proportion to the Scheduled Tribe population of each Gram Panchayat in relation to the total Scheduled Tribe population of the Gram Panchayat:

     

    • provided further that the Panchayat shall utilize the funds for such purpose and within such limits as may be recommended by the Gram Sabha, provided that, if there is more than one Gram Sabha in a Panchayat, the funds shall be utilized in proportion to the Scheduled Tribe population of the Gram Sabha concerned”A sum of not less than 5 percent of the total Tribal Component Programme Fund as highlighted in the Annual Financial Statement for the Scheme every year shall be made available in a lump sum at the beginning of the financial year to each Gram Panchayat in the Scheduled Areas of Maharashtra, in proportion to the total Scheduled Tribe population of the Gram Panchayat.

     

    “Appropriation: In order to utilize this fund for the implementation of the PESA Act, the fund may be appropriated for the following items in the annual and five-year plans.

     

    3.1) Planning and Management of Small Water Resources:

    Activities related to fisheries in lakes with an irrigation capacity of less than 100 hectares within the limits of the Gram Panchayat, activities that will increase the income of the Gram Panchayat through agriculture, tourism, boating and other commercial activities in these lakes, etc.

     

    3.2) Management of Minor Forest Production:

    Activities such as management of minor forest production found in government lands within the limits of the Gram Panchayat, preservation and conservation of minor forest production, collection and storage of minor forest production, small scale industries based on minor forest production, processing industries, purchase, sale and marketing, value addition of minor forest products, branding, packaging of minor forest products, etc. can be implemented.

     

    3.3) Management of Rural Markets:

    Gram Panchayats can undertake various tasks to manage the markets.  Funds can be used for development of market space, market stalls, drinking water arrangement for market vendors, arrangement of toilets, arrangement of parking lot, arrangement of electricity supply and lamps for the market (electricity bill cannot be paid) etc.

     

    3.4) Innovative activities related to PESA:

    Gram Panchayats can implement innovative activities for the effective implementation of PESA Act. Various activities can be implemented to celebrate PESA Day every year, innovative activities like Ran Bhaji Mahotsav etc. can be implemented. However, the approval of the District Level Control and Management Committee under the chairmanship of the Chief Executive Officer, Zilla Parishad will be required for innovative activities.

     

    3.5) Sustainable Livelihood Activities:

    Funds can be used for the sustainable livelihood of Scheduled Tribes within the Gram Panchayat limits. It will be mandatory for sustainable livelihood activities to be collective in nature.  However, permanent livelihood activities will require the approval of the District Level Control and Management Committee headed by the Chief Executive Officer, Zilla Parishad.

     

    3.6) Self-income generation activities of Gram Panchayats:

     

    Gram Panchayats can implement self-income generation activities from this fund. Gram Panchayats can implement various self-income generation activities such as construction and maintenance of commercial buildings, shops, etc. owned by Gram Panchayat, tourism development activities initiated by Gram Panchayat, planting orchards on land owned by Gram Panchayat, purchasing public utility materials, goods, tools, machinery and making them available on rent, etc.

    3.7) Infrastructure:

    Within the limit of the total available funds, the expenditure on construction for this component of infrastructure should not exceed 25%. This may include government buildings, internal roads in the village, sewage system, solar units, fire extinguishing systems in government buildings, schools, anganwadis, markets, etc., maintenance and repair works of government buildings and properties and similar infrastructure works. However, if infrastructure works are to be taken up from this fund; it will be necessary for the Gram Panchayat to submit a certificate along with the annual plan that funds will not be available for these works through various government schemes, programs, initiatives, and campaigns. The scrutiny committee should take care to verify the said certificate.

     

    3.8) Health, Sanitation and Education: If there is no possibility of funds being available through various schemes, programs, initiatives and campaigns of the government for health, sanitation and education related works within the Gram Panchayat limits, then the total available funds for Pesa village can be used for activities such as clean and pure drinking water facilities, purification of drinking water in public places, cleaning of village ponds, development of public water bodies, cleaning and strengthening of drinking water sources/sources, internal sanitation and solid waste management in the village, measures to prevent the spread of mosquito-like insects and epidemic diseases, essential facilities/items/equipment in the maternity ward of the primary health center/sub-center, purchase of educational materials in schools and anganwadis, making speaking walls in schools and anganwadis from an educational point of view, facilities such as libraries, libraries, study rooms etc. No personal benefits/materials can be given from this. However, if health, sanitation and education related works are to be taken from this fund; various schemes, programs, initiatives of the government,

     

    • Prohibited/Prohibited Matters of Fund Utilization:
    • The following works/undertakings cannot be taken up from the funds of this scheme.
    • 1) These funds cannot be used to implement works, initiatives, schemes which are generally done through various schemes, programs, initiatives, and campaigns of the government. If the same works which can be taken up through other schemes, programs, initiatives, and campaigns of the government are proposed through this scheme, then there may be duplication of works. Therefore, such works cannot be taken up from this scheme.
    • 2) No scheme, initiative, or program for personal gain can be taken up from this fund.
    • 3) Similar works like beautification of the village, painting, village entrances, development of religious places etc. cannot be taken up from this scheme.
    • 4) The funds of this scheme cannot be utilized for the collection of taxes of the Gram Panchayat such as property tax/house rent, water tax, sanitation and lamp tax, all types of electricity bills, establishment and administrative expenses of the Gram Panchayat, tea-water/snacks/meals for any program, reception ceremonies of various programs, purchase of office supplies, stationery, expenses on prizes and awards, etc.
    • 5) The amount of beneficiary contribution in any work or the amount of Gram Panchayat share of any work undertaken by the Gram Panchayat cannot be paid from this fund.
    • 6) Funds cannot be utilized from this scheme for implementing any festivals, ceremonies, yatras and celebrations, religious rituals and activities.
    • 7) Any kind of training, capacity building, awareness raising and study tour programs etc. cannot be taken up from this scheme. Regular training programs on PESA should be followed up through Rashtriya Gram Swaraj Abhiyan, Tribal Research and Training Institute, Pune. The skill and livelihood development programs that will be taken up under this scheme should be provided through relevant agencies such as Pandit Deendayal Upadhyay Grameen Kaushalya Yojana (DDU-GKY), Maharashtra Rural Livelihood Promotion Mission (UMED), Shabari Tribal Finance and Development Corporation, Maharashtra Entrepreneurship Development Center (MCED), Khadi Village Industries, Rural Self-Employment Training
    • Relevant Integrated Tribal Development Project Office etc.
    • 8) The funds of this scheme cannot be used for linking the funds of other schemes (Conversion/Gap Funding).

    National Gram Swaraj Abhiyan : The decision to implement the National Gram Swarajya Abhiyan has been taken at the government level and efforts are being made to strengthen the Panchayat Raj system by empowering the officials/employees and members of the Panchayat Raj system, providing infrastructure and information-education-communication programs. Are

    Objectives of training of Gram Panchayat members and women members through Panchayat Raj Training Center attached to the district as well as capacity building training of Village Development Officers/Gram Sevak through Gram Sevak Training Center were determined under National Gram Swarajya Abhiyan. In collaboration with State Rural Development Organization Yashda Pune, Hon. Training of Zilla Parishad members/ Panchayat Samiti members has been organized at Yashda Pune. Trainings/workshops are being organized and implemented at the three levels of District/Taluka/Gram Panchayat on strengthening of Panchayat Raj system, capacity building activities, basic facilities, availability of manpower.

    9 Concepts of Sustainable Development Localization and the objective of training the officials and staff of the Gram Panchayats who are completing the Nalpani Puravatha Scheme under the Water Life Mission has been completed.

     

    G. _ R. R (Aba) Patil Sumbar Gaon Award Scheme

    Government Decision of Village Development Department dt. According to the criteria of 21.11.2016, 8 talukas of Thane district have R. Under the R (Aba) Patil Sumbar Gaon Award Scheme, Gram Panchayats selected as Taluka Sundar Gaon are paid an award amount of 10.00 lakhs each. Also District Sundar village is selected from the selected Taluka Sundar, Village Panchayats selected as Zilla Sundar village will be paid an award amount of 40.00 lakhs.

    From the year 2016-17 to 2019-20, 8 Gram Panchayats have been selected as Taluka Sundar Gaon and the award amount has been paid to them. The award amount has been paid after being selected as a village.
